Terms and Conditions

1. Definitions

• Webyap Ltd.: Webyap Yazılım Limited Şirketi, the company that owns Crypnight.
• Account: The account on the Platform created by User, accessible via the Login Credentials.
• Signals: Recommendations for buying or selling cryptocurrencies shared by third-party "Signal Providers" engaging with Crypnight.
• Platform: The platform developed by Crypnight to enable Users to connect with Signal Providers and trade cryptocurrencies using a crypto trader bot.
• Subscription Term: The initial term of the Subscription, plus any subsequent renewal terms.
• User(s): Individual private persons or legal entities using the Services, also referred to as "you".

2. Registration and Personal Account

To use our Services, visit our Website and/or download our App. To access all functions of the Platform, you must register and create an Account. Provide your email address and choose a strong password during registration. The email address and password together form the "Login Credentials".

Through the Account, only fiat money can be deposited. Once deposited, it cannot be withdrawn. Any profits from using the bot can be withdrawn in fiat money. Cryptocurrencies cannot be deposited or withdrawn through the Account.

You may not allow third parties to use your Account. You are fully responsible for maintaining the confidentiality of your Login Credentials and for any activities that occur under your Account. If your Account is blocked or deleted for any reason, you are not entitled to use the Platform via another or new Account.

You warrant that the information provided when creating an Account is accurate and complete. You are responsible for the accuracy of the data in your Account.

Crypnight reserves the right to disable certain functionalities, deny an Account, or demand additional requirements for granting an Account.

3. Offers and Prices

All offers and free trials regarding the Services are subject to these Terms. Prices on the Website, App, and Platform do not include taxes and expenses unless indicated otherwise. Crypnight reserves the right to amend its prices at any time, effective immediately. Crypnight is not bound to any offer or quotation that can reasonably be understood to contain an obvious mistake or error.

4. Subscription

A subscription is required to access all functions of the Platform. Subscriptions are offered for a fixed amount per month or per year and can be applied for on our Website. Various packages are available, differing in positions, selected currencies, scanning frequency, and support. Subscriptions commence and expire according to the start and end dates indicated, unless terminated earlier.

The Subscription will automatically renew for the same period unless written notice of non-renewal is given via the Website or Platform. You have the right to withdraw the Subscription within 14 days of application.

5. Payment

The subscription price is paid monthly. Payment methods include PayPal, credit cards, and cryptocurrencies. If payment is not made within the period specified, Crypnight reserves the right to disable any functionality of the Platform or Account. The Account remains active for the period already paid for.

6. Fair Use of Our Platform

You must be at least 18 years old to use our Platform. You may not use the Platform in violation of applicable laws and regulations. You agree not to provide incorrect, inaccurate, or incomplete information, or engage in activities that violate any law, regulation, or acceptable standards.

Prohibited activities include, but are not limited to:

• Accessing non-public areas of the Platform.
• Sending viruses, spam, or unsolicited offers.
• Testing or violating Platform security.
• Using automated systems to withdraw data.
• Copying, distributing, or reverse engineering the Platform.
• Creating derivative works.

Crypnight may disable Platform functionalities if these terms are violated.

7. Privacy

Crypnight respects your privacy and complies with the EU General Data Protection Regulation (GDPR). We collect certain personal data when you use our Services. For details, see our Privacy Policy.

8. Intellectual Property

Crypnight holds all intellectual property rights related to the Services. Users are granted a non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Services in accordance with these Terms and the Subscription. Crypnight can withdraw this license if the User fails to comply with these obligations.

9. Availability of the Services and Disclaimer of Warranties

The Platform is available on compatible devices. Crypnight uses reasonable efforts to ensure access and functionality but cannot guarantee uninterrupted or error-free service. Crypnight is not responsible for the quality or content of Signals provided by Signal Providers.

Crypnight disclaims all implied warranties regarding the availability of the Platform. The Services are provided "as is" without warranty of any kind. Users assume full responsibility for the risks associated with using the Services.

Crypnight's liability is limited to $1000 USD or 100% of the total amount paid by the User for the Services in the preceding six months, whichever is lower.

10. Helpdesk

Crypnight provides a helpdesk for questions about the Services. We do not offer personal financial advice or recommendations. Tutorials and videos provided are general and not personalized.

11. Risks

Using our Services involves significant risks. You should fully understand these risks and only use funds you can afford to lose. Crypnight does not provide investment, legal, or tax advice. Consult independent professionals for advice based on your circumstances.

12. Indemnification

Users agree to indemnify and hold Crypnight harmless from all liabilities, damages, and costs arising from third-party claims related to the use of our Services or violation of these Terms.

13. Hyperlinks

Crypnight provides hyperlinks to third-party websites for convenience. We do not endorse or accept responsibility for the content or use of these websites.

14. Miscellaneous

Crypnight reserves the right to change these Terms. Significant changes will be notified via newsletter and posted on the Website. Continued use of the Services constitutes acknowledgment of the updated Terms.

These Terms are governed by the laws of Türkiye. All disputes resulting from or arising in connection with these Terms shall be exclusively submitted to the competent court of İzmir, Türkiye, unless settled amicably.
